SOUTH HARBOUR PROPERTY OWNERS ASSOCIATION, INC.
RESOLUTION ON SOCIAL MEDIA USAGE
The undersigned directors and officers of South Harbour Property Owners Association, Inc. (“Association”), an Indiana nonprofit corporation, hereby certify that the following resolution has been adopted by the Association’s Board of Directors as of the date set forth below:
WHEREAS, the Association, from time to time, may utilize social media such as Facebook, Twitter, LinkedIn, and other similar medias for the purpose of providing information concerning community events, governance, meetings, news and other similar information;
WHEREAS, social media is a powerful communications tool that offers an open forum for debate, exchanging ideas, discussing issues and sharing opinions;
WHEREAS, because of the open communication forum created by social media, there can be negative ramifications to the community and its members if social media is abused or improperly utilized;
WHEREAS, the Association’s Board of Directors, for the purpose of protecting the Association and its members and minimizing any negative impacts or damage social media may have or cause to the community as a whole, believes it is in the community’s best interest to adopt guidelines, expectations and rules governing the use of Association-sponsored social media pages.
NOW, THEREFORE, The Board of Directors adopts the following Social Media Policy (hereafter, the “Policy”):
1. Purpose:
Use of social media can benefit the community by disseminating essential information in an expedient manner, keeping owners abreast of community news and activities, increasing transparency, and encouraging interaction among neighbors. However, there can also be negative ramifications to the community and its members if social media is improperly used. The purpose of this Policy is to establish guidelines and expectations for the use of any social media sponsored by the Association in order to protect the community, its members and the Association, while maximizing the benefit derived by the members.
2. Member Responsibilities:
When utilizing social media, members must understand that social media pages and/or applications are not necessarily private and their security cannot be guaranteed. In that regard, the Board expressly discloses that it cannot guarantee who will be able to access the information members choose to post on Association-sponsored social media sites. Members should take this
into consideration before posting and should assume that all postings to websites and/or applications subject to the Policy will be publicly available on the Internet and therefore publicly accessible without limitation or protection of any kind.
Members who use the Association’s social media pages assume all risk attendant to the use of social media. Members who choose to use these websites and/or applications agree to release and hold harmless the Association, its Board, and the community’s Managing Agents for and from any claims, causes of action or damages that may arise relating to the members’ use of Association-sponsored social media websites and/or applications.
3. Social Media Defined:
Social media is defined as media intended to be disseminated through social interaction, created using highly accessible and scalable publishing techniques. Examples include but are not limited to LinkedIn, Twitter, Facebook, YouTube, Instagram, Snapchat, Websites and blogs.
4. Posting
Use of the Association’s social media pages is limited to South Harbour homeowners, members of the Board, and the community’s Managing Agent.
While the Board encourages interaction among the community’s members, it will not tolerate posting that is vulgar, bullying, harassing, obscene or in bad taste. Posts should be limited to constructive, meaningful discussion regarding the Association’s affairs, events and activities. Furthermore, social media pages are NOT the proper communications forum for making individual inquires and requests relating to a person’s individual interests or property, such as, but not limited to, maintenance requests, questions regarding payment of assessments, complaints regarding other members, and other individualized concerns and requests which lack general applicability to the membership.
Some or all of the Association’s social media pages may permit members to write posts or make comments in respect to information posted on the page, or to “interact” with others in the form of posting and comments. Posts and comments containing any of the following items are prohibited and will be deemed a violation of this Policy:
Vulgar language
Personal attacks on individuals or specific groups.
“Trolling,” which is defined as posting deliberately disruptive comments meant to harass, threaten, bully or abuse an individual, group, or other users of the social media page.
Content which intentionally discriminates or has the effect of discriminating on the basis of race, creed, color, age, religion, gender, familial status, sexual orientation, physical or mental disability, or any other form of discrimination as may be determined by the Board.
Stalking or attempts to collect private information.
Content relating to confidential or proprietary business information.
Inappropriate images or photographs, including, but not limited to, depictions of violence, sexual content, nudity, pornography, and other images the Board may, in its discretion, deem to be offensive or obscene.
Material that is threatening, harassing, bullying, illegal, obscene, incendiary defamatory, libelous, or unduly hostile toward another individual or individuals.
Spam or links to other websites/pages.
Content advocating illegal activity, discrimination, hate, violence, or harm to another person or persons.
Posts of a commercial nature (i.e. promoting a business or goods/services).
Infringements on copyrights, trademarks, or other intellectual property laws.
Information that may compromise the safety, security, or proceeding of any legal action pertaining to the Association.
Posting comments under another person’s or a fictitious name.
The posting of personal views as representing those of the Association as a whole.
Any other content determined by the Board to be offensive, in poor taste, disruptive, obscene, or otherwise contrary to the use, purpose, and goals of the social media page.
The Board may, in its discretion, remove and/or edit any post, comment, or content, without notice, if it determines such post, comment, or content violates this Policy. The Board further reserves the right to remove or block any individual or group from posting and/or participating in the social media page, without notice or explanation, if the Board determines such individual has repeatedly violated the terms of this Policy.
5. Code of Conduct
Owners agree to ensure their posts are civil, ethical, courteous and constructive in nature. Owners are solely responsible for the content they post. The Association is not liable for the accuracy of any post or comments made by an owner.
Amendment
This Policy may be amended at any time, in whole or in part, by the Association’s Board of Directors.
